What we look at
Where it happened
The incident took place in California or Nevada. Injuries outside those states fall outside what our office can handle.
How long ago
Generally within the last two years, with at least three to six months left before the deadline. If you are close to the deadline, an attorney reviews it personally — call instead of waiting.
How serious the injuries are
More than minor scrapes: broken bones, fractures, head injury, surgery, significant bruising, or tissue and organ damage. Ongoing symptoms still being evaluated also count.
Medical records
Some record of the injury — ER, urgent care, a doctor, chiropractor, imaging, or therapy. If you have not been seen yet, say so; it does not automatically end the review.
Whether you already have a lawyer
If another firm currently represents you on this matter, an attorney reviews the situation before we can talk about the case.
Every case is different
These are guidelines, not a scorecard. Strong facts create room on the softer criteria — a serious injury with treatment still ahead of you can still be worth reviewing. If the screening says the firm may not have capacity, that is a decision about our caseload, not a judgment about your rights.
This questionnaire is a preliminary screening tool only. It is not legal advice, and your answers do not create an attorney-client relationship with Black Diamond Law. No attorney-client relationship is formed unless and until you and the firm sign a written engagement agreement.
Deadlines to bring a claim (statutes of limitations) vary and exceptions may apply to your situation. If you believe your circumstances are unusual, call us — do not rely on this screening tool to determine your legal rights.
